These Terms and Conditions govern the conditions of use and transactions on the Circularia platform, which connects professional and private sellers and buyers.
Circularia does not own the products and does not act as a seller.
Article 2 – Products
The products are sold second-hand.
Sellers must indicate: condition, dimensions, any defects, authentic photos.
Article 3 – Prices
Prices are set freely by sellers.
They are displayed inclusive of VAT.
Additional costs (delivery, handling, etc.) are indicated before ordering.
Article 4 – Ordering
– Confirmation of the order = acceptance of prices and specifications.
– Circularia transmits information between buyers and sellers.
– Circularia may provide a secure payment method.
Article 5 – Payment
– Conditions defined by each seller.
– Circularia may charge a commission on the transaction (if applicable).
– In the case of secure payment, Circularia guarantees the successful receipt of funds.
Article 6 – Delivery
– Provided by the seller or a service provider chosen by them.
– Risks are transferred to the buyer upon delivery to the carrier.
– Circularia is not responsible for delays or losses.
Article 7 – Cancellation
– Consumers: legal right of withdrawal within 14 days, except in certain cases.
– Professionals: no right of withdrawal unless agreed by the seller.
Article 8 – Guarantees
– Legal guarantee of conformity.
– Guarantee against hidden defects.
Circularia is not liable for disputes relating to product quality.
Article 9 – Liability
Circularia is not liable:
– for advertisements published by sellers
– for the actual conformity of products
– for transactions carried out outside the platform
– for disputes between members
Article 10 – Disputes/mediation
– In the event of a dispute between a seller and a buyer, Circularia may offer amicable mediation.
– Competent court: place of Circularia’s registered office.
